Ownership transformation of state enterprises as of January 31, 2006

In the period between August 1, 1990 and the end of January 2006, privatisation processes were initiated in 5,720 (18)1 state enterprises under the Act on Privatisation of State Enterprises, the Act on Commercialisation and Privatisation of State Enterprises and article 19 of the Act on State Enterprises.

 

In the register of state enterprises (REGON), as of December 31, 2005, there were 1,029 state enterprises, including 24 enterprises for which the founding body was the Minister of the Treasury and one state bank.

 

As of the end of December 2005, the Minister of the Treasury supervised 1,405 companies, including 426 sole shareholder companies of the Treasury (sole shareholder companies of the Treasury) and 979 companies in which the Treasury held shares.

 

As of January 31, 2006, 1,584 (9) state enterprises were commercialised (i.e. 27.7% of the total number of enterprises under transformation), which resulted in establishment of:

 

 

 

 

  • 1,567 (9) sole shareholder companies of the Treasury,
  • 17 companies with participation of creditors, in accordance with Section III of the Act on Commercialisation and Privatisation (commercialisation with conversion of liabilities).

 

In January 2006, 6 state enterprises were commercialised, for which the founding body was the province governor:

 

 

 

 

 

 

 

 

 

 

 

 

 

  • Przedsiębiorstwo Państwowej Komunikacji Samochodowej w Suwałkach (the founding body: the governor of the podlaskie province),
  • Przedsiębiorstwo Państwowej Komunikacji Samochodowej w Białymstoku road transport enterprise (the founding body: the governor of the podlaskie province),
  • Kopalnie Odkrywkowe Surowców Drogowych w Legnicy with its registered seat in Wilków opencast mining of road construction material (the founding body: the governor of the dolnośląskie province),
  • Przedsiębiorstwo Wydobycia i Obróbki Marmuru "MARMUR" w Sławniowicach marble extraction and processing enterprise (the founding body: the governor of the opolskie province),
  • Wągrowieckie Przedsiębiorstwo Robót Mostowych w Wągrowcu bridge construction and maintenance company (the founding body: the governor of the zachodniopomorskie province),
  • Górnośląskie Przedsiębiorstwo Wodociągów w Katowicach water utility (the founding body: the governor of the śląskie province).

 

Between August 1, 1990 and January 31, 2006, the Ministry of Ownership Transformation / Ministry of the Treasury and the Privatisation Agency made available shares / stakes in 1,021 (3) Treasury companies:

 

 

 

 

 

 

 

 

 

 

 

  • 6 (2)through taking up shares in the increased initial capital of sole shareholder companies of the Treasury by entities specified in article1, paragraph 2.1 of the Act on Commercialisation and Privatisation,
  • 359 (1) – by way of indirect privatisation (sole shareholder companies of the Treasury),
  • 17 - in accordance with Section III of the Act on Commercialisation and Privatisation,
  • 127 - under the framework of BPU (banking settlement procedure) – liabilities swap,
  • 512 - by way of contribution of shares / stakes to National Investment Funds (NFI).

 

In January 2006, privatisation was initiated, through the transfer of 70% of shares, by way of invitation to negotiations, in Zakłady Przemysłu Tłuszczowego w Warszawie S.A. fats and oils company, the investor: OLVIT-PRO Sp. z o.o.

 

In January 2006, privatisation of 3 companies with partial Treasury shareholding was continued through the sale of subsequent blocks of shares:

 

 

 

 

 

 

 

  • Lubelskie Przedsiębiorstwo Budownictwa Ogólnego S.A. w Lublinie construction company – 25.64% of shares, the investor: Agnieszka Buchajska, privatisation completed,
  • Przedsiębiorstwo Robót Komunikacyjnych w Poznaniu S.A. communications engineering company – 25% of shares, the investor: Newag S.A., privatisation completed,
  • Zakłady Chemiczne “Wizów” S.A. w Bolesławcu chemical plant – 25.21% of shares, the investor: Marcin Chwała S.A., privatisation completed.

 

 

Between August 1, 1990 and the end of December, 2005, 2,252 (6) applications for direct privatisation were accepted, in accordance with article 37 of the Act on Privatisation of State Enterprises and article 39 of the Act on Commercialisation and Privatisation (that figure accounts for 39.4% of the total number of transformed enterprises). 2,159 (4) state enterprises were struck from the register.

 

In January 2006, 2 directly privatised state enterprises were struck from the register of enterprises.

 

In the period between August 1, 1990 and the end of January 2006 no objections were raised towards 1,884 (3) applications for liquidation because of poor financial situation in accordance with art. 19 of the Act on State Enterprises. This figure accounts for 32.9% of the total number of transformed enterprises. 1,032 (10) enterprises were struck from the register, while in 676 bankruptcy was declared.

 

In January 2006, removal from the register of entrepreneurs completed liquidation in 1 enterprise.
